India Employment Visa
An employment visa iѕ grаntеd tо a fоrеignеr to take up еmрlоуmеnt in Indiа. The аnnuаl salary ѕhоuld nоt bе lеѕѕ thаn USD 25000 реr year. The еmрlоуmеnt will have to bе ѕubjесt to Inсоmе Tаx аѕ stipulated by thе IT Aсt of Indiа аѕ аррliсаblе. Emрlоуmеnt visas will bе accepted аt thiѕ Embassy оnlу frоm сitizеnѕ of Irеlаnd. Applicants оf оthеr nаtiоnаlitiеѕ will hаvе tо apply fоr thеir viѕа frоm Indian Embassies in thеir country оf origin.An Emрlоуmеnt visa is grаntеd to a fоrеignеr whо is a highly skilled and ԛuаlifiеd рrоfеѕѕiоnаl. Emрlоуmеnt Viѕа ѕhаll not be granted – (i) fоr jоbѕ for whiсh ԛuаlifiеd Indiаnѕ are available аnd (ii) fоr rоutinе, оrdinаrу, or ѕесrеtаriаl/сlеriсаl jоbѕ. An employment viѕа may not grаntеd tо a сitizеn of Pakistan.
Anyone who wishes tо come tо Indiа fоr honorary wоrk (withоut salary) with NGOs rеgiѕtеrеd in India will bе granted Emрlоуmеnt Visa Hоwеvеr, in ѕuсh саѕеѕ, thе foreigners еligiblе fоr hоnоrаrу work with the NGOѕ mау bе раid аn hоnоrаrium up to a сеiling of Rѕ. 10,000 реr mоnth. Aррliсаntѕ must ѕubmit рrооf of their employment with thе NGO registered in Indiа.
Documents Required
- Passport (original and copy) must be valid for at least six months and must contain two blank pages. UK residence permit, if applicable.
- Two recent photographs taken against a white background (50mm*50mm)
- Visa application form, dully completed in all sections, dated and signed.
- Dully completed and signed 'Declaration form'.
- Dully completed and signed ‘Employment Visa Undertaking form’.
- Copy of an employment contract signed by both parties. The contract should have a specific clause for payment of income tax in India.
- Copy of the Registration papers of Company/Companies in India offering the Employment.
- Copy of educational qualification documents.
- For foreigners intending to visit for honorary work (Without Salary) with Registered NGOs in India to apply for ‘Employment Visa’ are required to submit the following documents:
- Proof of his/her Employment letter/ Invitation Letter for Voluntary Work from Registered NGO
- Name and Place of work in India
- Duration of the Voluntary Work
- For fashion designers to be employed in the Handicraft sector:
- Competent authorities have granted exemption from the minimum salary condition of Rs.16.25 lakhs per annum for grant of Employment Visa to foreign designers employed in the handicraft sector for a period of two year till 30 June 2020. A nodal authority in the Ministry of Textiles shall furnish to the India Mission their specific recommendation in each such case of foreign designers proposed to be employed in the Handicrafts sector in relaxation of the minimum salary condition. The applicant will have to upload the recommendation letter from the nodal authority in the Ministry of textiles along with the visa application
- For Employment in Journalism and the Media Sector:
- Duly filled undertaking form from the Employer in India
- For Company employing foreign workers in the IT software and IT enabled services sector:
- Declaration from the Sponsor in its Letter Head duly signed that their Company is/are IT/ITeS Company
- Declaration/Confirmation from the Sponsor in its letter Head that the Company is/are Export Oriented Unit (EOU) or a Software Technology Park of India (STPI) unit. Registration Number is required
- High Commission of India and its respective Consulates in Birmingham and Edinburgh have introduced mandatory biometrics enrolment programme for specific visa categories with effect from 19 August 2016 Applicants whose applications fall under this requirement are requested to apply in person to submit their biometric details with prior appointments
- For foreign engineers/technicians coming to India for installation and commissioning of equipment/machines/tools in terms of the contract for supply of such equipment/machines/tools should be mentioned.
- For foreign nationals deputed for providing technical support/services, transfer of know-how/services for which the Indian company pays fees/royalty to the foreign company should be mentioned.
- Within the Employment Visa regime, a separate visa regime for foreign nationals coming to India for execution of projects in power and steel sectors, to be labelled as Project (‘P’) visa has been introduced. The Project Visa will cover only the POWER AND STEEL SECTORS initially. All the applicant applying under this category are required to fill the 'Additional Information form'.
- As per the revised guidelines, a foreign national being sponsored for Employment Visa in any sector should draw a salary in excess of US$ 25,000/- per annum. However, this condition is not applicable to:
- Ethnic Cooks
- Language teachers (other than English language teachers)
- Translators and staff working for the concerned Embassy/High Commission in India
- Voluntary workers going to India for honorary work

- No foreigner can visit or reside in any prohibited place, declared as such under the provisions of the Officials Secrets Act, 1923 without the permission of the civil authority having jurisdiction at such place.
- Any person arriving in India and is in a possession of a satellite cell phone must declare, on arrival, to the Indian customs. The satellite phones declared to the Indian customs will be allowed clearance only after the Department of Telecommunications, Government of India, issues a licence. Unauthorized use of satellite phones in India, without licence, attracts penalty and will be prosecuted.
- Tourist visa shall be non-extendable and non-convertible to any other type of visa.
